It will be a great helpful to me if anyone suggest or share any similar case studies.<br />I have joined an RRB under sponsorship of UBI as an EXSM. As all are doing, I applied for pay fixation after joining. But after so many approaches, I was told to wait for some time. lastly, I was inform that I am not eligible for pay fixation, reason being I am not selected in EXSM quota. I had applied in OBC-ESM category. But selected in OBC cat because there was no vacancy reserved for ESM. But the DOPT guidelines and IBA instructions say" exams who joined......" I had even questioned them What will be the case in case two ESMs who joined a bank one in ESM quota and one as OBC reserved seat by virtue of getting higher mark.", that too will the ESM who got the ESM quota will only get the pay fixation?<br /><br />Plse throw some light on this. I was not drawing any pension from Navy as I was not entitled for pension being served the Navy for Ten years. In the year 1976 one could leave the Navy after completion of initial engagement of Ten Year, but will not be entitled for pension. i joined p.N.B. in the year 1977 as clerk-cum-typist. My last pay drawn in the Indian Navy was not protected. The only benefit given was appointment against reserved vacancy of ex-servicemen. There was no scheme of pension in PSB in the year 1976 and scheme for contributory Provident fund was prevalent. The Scheme of pension was introduced in PSB in the year 1995, but I did not opt for it. I took VRS in the year 2000 under Special VRS introduced in PSB. As I was not pension op tee there was no question of pension. The Scheme of Pension was again introduced in the PSB in the year 2009 and I opted for pension. My pension was fixed taking into account 23 years of active service in PNB extended by five years as per prevalent rule. As such my pension was fixed for 28 years and on the basis prorate pension was fixed. I was not given full pension for 33 years. I approached PNB for giving me full pension for 33 year, but my request was turned down. Now I am contemplating to go to court for grant or full pension for 33 years taking into consideration my Ten Years of Navy Service for pension purposes as I have not been given the benefit of my pay protection nor any other benefit for my Ten Years of Service in the Indian Navy. First, Bank is autonomous in their HR. Second, there is no pay protection provided to ex servicemen re-employed in central government. Though the bank is doing pay fixation but it is following the guide lines issued by DOPT which is very confusing. Further DOPT guide lines only give leverage to short service commissioned officer otherwise its guidelines ensured that basic pay and basic pension received by PBOR and permanent commissioned officer on re employment should be lower or exactly at par with basic pay drawn at the time of discharge from military service. Third, For pay fixation, Banks follow the guidelines of IBA, IBA follow the guidelines of DOPT so DOPT does not have guidelines which deals with pay fixation of PBOR. Fourth, Now question can be raised why bank is doing pay fixation to PBOR since long back? Here is the reason. As I said DOPT guide lines are very confusing and in confusion pay protection is given to PBOR at bank since long back. Further, in past years, the initial term of engagement for PBOR was 9 years and giving pay protection will not lead to surrender of DA as after 9 years PBOR not entitled for pension so there was no much loss. PBOR in IAF become Sergeant after completion of 8 years of service in IAF. It means sergeant have sufficient knowledge and experience of an organization. The knowledge and experience of PBOR was recognized by bank and they continue to giving pay protection to PBOR. <br />IAF increase the term of engagement from 9 years to 15 years and further to 20 years. Thus PBOR were bond to serve the IAF till completion of bond. In this way, We see that IAF mold the service conditions to use knowledge and experience of PBOR for smooth functioning of organization and to achieve reduction in work and responsibilities of officers. But guidelines issued by DOPT remains same as these guidelines take care of ex-servicemen who served the armed forces for 9 years. This can be very well verified while you apply for re-employment. In advertisement you will find it under definition of ex-servicemen. This definition says that whether you serve say for 5 or 10 or 15 or 20 years, you are an ex-servicemen and entitled for ex-servicemen reservation for group C and D post and age relaxation. In this way, PBOR faces double damage to his career. First stagnation in IAF resulting loss of pay and status in IAF second there is no career in civil job after putting 20 years service in IAF. Because your age is more resulting tough competition with young people rapidly changing technology and education. Though knowledge and experience gained in IAF is more than sufficient but PBOR lags in educational knowledge because this was acquired though distance learning mode which leads to weakness in theoretical aspect. <br /><br />In view of the above you will find that career of PBOR not protected taking into consideration the changing service condition of IAF and changing civil environment. Therefore most of the PBOR are suffering in terms of pay and status. PBOR problems can not be solved by individually. Still, I had been not at all considered for Pay Fixation by the Bank. It is notable that recently Central Govt has passed the Bill for ONE RANK ONE PENSION to compensate such status issues of Ex-Servicemen. Only slight variation could be observed while comparing the Basic Pay + Grade Pay + Class Pay and other allowances for all Ex-Servicemen of the same rank in the bank. In point of fact it had been informed me that, since I haven’t had DA (DA was not allowed during Jan 2006) as per last pay certificate, I shall not be bestowed with pay fixation. <br /><br />While on Pay fixation DA (Dearness allowance) may not be considered as obligatory because it is benefited only to mitigate the impact of inflation on people. It may be varied time to time. If the DA is converted as Dearness pay, then the same should be added with basic pay for revision. Subsequent appeal had been given many times that I may please be reconsidered by reviewing the Basic Pay + Grade Pay + Class Pay and other allowances which were given to my entry-mates during pay fixation.
